Nicolas Canon Mentoring – Terms, Conditions & Liability Waiver

Applies to all online programs, live workshops, retreats, and related services offered by Nicolas Canon Mentoring. By registering, paying, or attending any program, you acknowledge that you have read, understood, and agreed to the terms below.

1. Eligibility

• You must be at least 18 years old to participate.
• You must be fluent in the language in which the program is conducted.

2. Service Agreement & Pre-Purchase Process

• Before any payment is processed, you will receive a written program proposal that describes the service, its scope, duration, deliverables, and pricing.
• You must review and sign a service agreement confirming you understand what is included and agree to the terms before any charge is made.
• No payment will be collected until both parties have signed the service agreement.
• The signed service agreement, together with these Terms and Conditions, constitutes the full agreement between you and Nicolas Canon Mentoring.

3. Payment & Registration

• Payment in full (or an agreed deposit as outlined in your service agreement) must be received for your registration to be confirmed.
• By making any payment, you confirm that you have received the program proposal, signed the service agreement, and accepted these Terms and Conditions in full.
• You are responsible for all outstanding balances as outlined in your service agreement.
• Payments may be made via Stripe, PayPal, Wise bank transfer, wire transfer, or cash (in approved cases).
• All charges will appear on your statement as “Nicolas Canon Mentoring” or an associated descriptor.

4. Refund, Cancellation & Rescheduling Policy

Our refund policy varies by service type. We are committed to delivering real value and standing behind our programs — which is reflected in our strong track record of satisfied clients over multiple years of operation.

a) Online Programs

• If after 4 weeks of active participation you are not satisfied with the program, you may request a full refund by contacting us in writing at the email address listed below.
• Refund requests must be submitted within 28 calendar days of your enrollment date.
• Refunds will be processed to the original payment method within 10 business days of approval.
• After the 4-week window has closed, no further refund requests will be accepted.

b) Live Workshops & One-Time Events

• All workshop and live-event payments are final and non-refundable.
• Because these are limited-capacity, in-person events, your registration secures a spot that cannot be offered to another participant once confirmed.
• If you are unable to attend, you may transfer your spot to another person you nominate, provided you notify us in writing at least 7 days before the event.

c) Retreats

• Retreat payments are non-refundable.
• If you cannot attend, you may reschedule to a future retreat (within 12 months of your original date), provided you give us written notice at least 30 days before the start date.
• Less than 30 days’ notice forfeits the option to reschedule.
• You may also transfer your spot to another participant you nominate, with written notice at least 30 days prior.
• In the event of rescheduling due to circumstances beyond our control (e.g., travel restrictions, natural disasters), your payment will be credited toward the next available retreat.

5. Service Description & Delivery

• All services provided by Nicolas Canon Mentoring are educational in nature, including mentoring programs, workshops, and experiential retreats.
• A detailed description of the service you are purchasing — including content, format, schedule, and any materials provided — will be included in your program proposal and service agreement.
• Online programs are delivered via digital platforms; access details are provided upon confirmed enrollment.
• Workshops and retreats take place at the venue, date, and time specified in your service agreement.
• We reserve the right to make reasonable adjustments to scheduling or venue if necessary, with advance notice to participants.

6. Assumption of Risk & Liability Release

• You acknowledge that retreats and events may include physical activities (e.g., movement practices, ceremonies) and emotional processes that carry inherent risks.
• You voluntarily assume all risks and agree that Nicolas Canon, Nicolas Canon Mentoring, Ambi Comunidad, and associated facilitators are not responsible for any injury, illness, loss, or damages you may experience.
• This includes risks from travel and all retreat activities.
• You release and hold harmless all listed parties from any and all claims, known or unknown, now and in the future, arising from your participation.

7. Health & Medical Acknowledgment

• You affirm that you are physically, emotionally, and mentally fit to participate.
• You understand that these programs are not a substitute for medical treatment, therapy, or psychological counseling.
• You agree to consult your physician before participating, especially if you have any medical conditions.
• You are responsible for disclosing any relevant health information prior to attending.

8. Conduct & Participation

• You agree to participate fully, respect facilitators and fellow participants, and follow all program guidelines.
• Disruptive, disrespectful, or unsafe behavior may result in removal without refund.
• For retreats, you agree to remain for the full duration unless otherwise discussed with facilitators.

9. Intellectual Property

• All program and retreat materials are protected by copyright.
• You may not reproduce, distribute, or share any materials without written permission.

10. Data Protection

• By registering, you consent to our use of your personal data in accordance with applicable privacy laws.
• We will never sell or share your personal information with third parties for marketing purposes.

11. Dispute Resolution & Contact

• If you have any concerns about a charge, a service you received, or wish to request a refund, please contact us directly before initiating a dispute with your payment provider. We are committed to resolving issues promptly and fairly.
• This agreement is governed by the laws of the State of New York (for international matters) or Colombia (for in-country matters).
• Any disputes that cannot be resolved directly will first be submitted to mediation, and if unresolved, to binding arbitration under ICDR rules.
• We each waive any right to trial by jury.

12. Acknowledgment

By submitting your registration and payment, you confirm that:

• You have received and reviewed a written program proposal describing the service.
• You have signed a service agreement before any payment was processed.
• You understand that this document is legally binding.
• You have read and understood this agreement in its entirety.
• You voluntarily accept all terms, including the refund policy and assumption of risk applicable to your service type.
